Michigan is a "one-party consent" state for audio recording. This means:

  • You can legally record conversations as long as one person participating in the conversation consents
  • Recording conversations you are not participating in violates Michigan's eavesdropping statute
  • Violating the eavesdropping law is a felony punishable by up to $2,000 in fines or two years in prison

 

"These types of cases focus on whether there's an expectation of privacy," said Symantha Heath, partner at Novi-based Elkouri Heath PLC law firm. "In public settings, where there isn't an expectation of privacy, the statute wouldn't necessarily apply."
