A 34-year-old Battle Creek man is facing a charge of open murder following a multi-agency investigation into a missing person report that originated with the Marshall Police Department, the Battle Creek Police Department said in a Sept. 1 news release.

The BCPD Detective Bureau partnered with the Calhoun County Major Crimes Task Force to investigate the missing person's report on Aug. 27.

How the Investigation Unfolded

"During an unrelated investigation that same day, Battle Creek police officers responded to a felony complaint involving the missing person's vehicle," BCPD said in the release. "Using commercial surveillance video and the city's License Plate Recognition technology, investigators identified and later located the vehicle in the possession of an adult male in Battle Creek and arrested him on charges unrelated to the missing person investigation."

As detectives continued to pursue investigative leads, evidence indicated the missing person had been in Battle Creek. Through interviews and the examination of evidence, detectives later located the missing person deceased within Battle Creek city limits.

What Is Open Murder in Michigan?

In Michigan, an open murder charge allows prosecutors to pursue either first-degree or second-degree murder convictions based on the evidence presented. First-degree murder carries a mandatory sentence of life in prison without parole. Second-degree murder carries a sentence of up to life in prison with the possibility of parole.

The charge gives prosecutors flexibility as they evaluate the circumstances and evidence of the case.

Multi-Agency Cooperation

This case highlights the cooperation between multiple law enforcement agencies in Calhoun County. The Battle Creek Police Department Detective Bureau, the Calhoun County Major Crimes Task Force, and the Marshall Police Department all played roles in the investigation.

The use of License Plate Recognition technology and commercial surveillance video was instrumental in tracking the victim's vehicle and identifying a suspect.
